According to an analysis by the Guardian's Peter Stone, Donald Trump's lawyers' losing streak in the courts is slowly grinding down any defenses they can put forward as they now face the prospect that his loyalists will be forced to testify.

As Stone notes, members of Trump's inner circle have run out of reasons to avoid talking about the 2020 presidential campaign and the aftermath of a lost election -- including attempts to overturn the election results -- and that has put investigators in the driver's seat.

Special counsel is 'coming in guns blazing': Former DOJ official

Former Justice Department official and ex-federal prosecutor Harry Litman noted the latest court filing by special counsel Jack Smith on Thanksgiving day. He joined MSNBC's Nicolle Wallace in saying the tone was the part that really made him take notice.

"They made a misrepresentation of what a case stood for," Litman said about Donald Trump's lawyers. He came right back with that paragraph that sounded around the world, not just in that court, holding their feet to the fire. And he's got a reputation for being aggressive. This was an aggressive move. They were wrong but he could have thought the court will figure it out, don't come in guns a' blazing. He did, however. And I think it's a real indication of the kind of special counsel he's going to be."

Trump is now attacking the sister-in-law of the special counsel

Donald Trump is going all-in on attacks against the family of special counsel Jack Smith. Instead of mounting a defense for his actions, Trump deployed one of his top tactics: attacking anyone trying to hold him accountable.

Legal experts predicted that the 11th Circuit Court of Appeals will soon shut down the special master process in the Mar-a-Lago probe that was ordered by U.S. District Judge Aileen Cannon.

The special master process ordered by Cannon, a Trump appointee, effectively allows former President Donald Trump to challenge the search warrant at his office and residence before he is indicted — an extremely rare opportunity for a criminal defendant.

The oral argument by prosecutors, who are now under the direction of the newly appointed Special Counsel Jack Smith, shows that the 11th Circuit may be close to reversing Cannon's process. The three judges on the panel — two of whom are Trump appointees — shared their skepticism that Cannon had jurisdiction to take action before an indictment, and that even if she did, she had no factual predicate to appoint a special master.
